I am officially rejecting the dealership's requests to appraise or trade in this vehicle, and I am demanding a full manufacturer repurchase (buyback) of the vehicle for my purchase price, down payment, finance charges, associated fees and taxes under the federal Magnuson-Moss Warranty Act. Background of Failed Repairs My vehicle has already spent 15 cumulative days out of service for an ongoing engine defect. An authorized Mercedes-Benz dealership recently diagnosed the vehicle and performed a major cylinder head assembly job/replacement to resolve engine misfires and a persistent Check Engine Light. This defect is well-documented by Mercedes-Benz under its active 15-year/150,000-mile extended warranty program for the M260 engine cylinder head. The Critical Safety Incident Despite the recent cylinder head replacement, the Check Engine Light has returned, signaling a total failure of the repair. More critically, on August 25, 2026 while driving the vehicle, the engine catastrophically stalled without warning in live traffic. Due to the sudden loss of engine power, power steering, and braking assist, I was nearly involved in a severe traffic accident. This vehicle is inherently unsafe, unroadworthy, and poses an immediate danger to myself and others on the road. Formal Demands Immediate Buyback Processing: Because this vehicle cannot be repaired after a major engine overhaul and now actively stalls, I am demanding a full refund of my purchase price, down payment including all associated taxes, fees, and finance charges.
