The contact stated that there was a gap of approximately ¼-inch between the top of the liftgate on the passenger side and the door frame when the tailgate was closed. The gap on the driver's side of the liftgate was not as pronounced as the gap on the passenger’s side. The contact stated that the liftgate appeared unbalanced. The contact stated that the liftgate was making abnormal creaking sounds while being raised or lowered. The contact stated that the latch where the liftgate locked to secure the liftgate showed scratches. The contact had taken the vehicle to a local dealer, where some minor adjustments were performed on the latch. The contact stated that the liftgate failure was not addressed. Manufacturer Recall Number: 25TB12 NHTSA Recall Number: 25V668 This recall was created almost three months, but we were not notified of it until receiving a letter a few weeks ago. That means we were putting our children in unsafe seats for two months! Why is the manufacturer allowed to wait so long to contact us about such a serious safety issue? Furthermore, why aren't they required to pay for us to rent comparable vehicles until they are able to fix the issue? Not being able to use the middle row of seats completely nullifies the utility of owning a minivan in the first place. What avenues are available to me for seeking recompense in this case?

I purchased this vehicle on March 8, 2025. On October 7, 2025, I was notified of Safety Recall 25TA12 involving the second-row seats. Due to this safety defect, the second row cannot be used, rendering the vehicle unsafe and impractical for its intended purpose. This vehicle was purchased specifically to transport my family of five, including three children (currently ages [XXX] , [XXX] , and [XXX] ), all of whom require car seats. It is not physically possible to safely install three car seats in the third row of this vehicle, particularly an infant seat. As a result, I cannot safely transport my children and the vehicle cannot be used as a family vehicle. As of January 5, 2026, more than 90 days have passed since I was notified of the recall, and I have been informed that there is still no available remedy or repair timeline. During this period, I continue to make monthly payments of approximately $1,000 on a vehicle that does not meet basic safety and usability expectations. No adequate resolution or interim accommodation has been provided. Owning a family vehicle with a known safety defect and failing to provide a remedy for over 90 days is not acceptable business practice. The vehicle cannot fulfill the purpose for which it was purchased, and the ongoing financial obligation without a resolution is unreasonable. I am requesting either a buyback of the vehicle, including associated costs, or a replacement vehicle of comparable value. This issue has persisted for an excessive period of time without resolution and requires immediate corrective action. My vehicle is subject to a safety recall issued on October 7 for improperly welded second-row seat rails. Toyota has stated that if these seats are occupied during certain high-speed collisions, they may lose structural integrity, increasing the risk of injury. Because these seats are required to safely transport my young children, the recall renders the vehicle unsafe and unusable for its intended purpose. It has now been over three months since the recall was issued, and Toyota has not provided a remedy. The dealership has no information regarding when repairs will be available, and our vehicle is currently being held at the dealership. Toyota has provided a rental vehicle; however, this does not resolve the issue. The rental is not the same vehicle we purchased, does not meet our family’s needs, and requires frequent renewals, creating an ongoing burden. We purchased this vehicle specifically to meet our transportation needs and remain unable to use it. The vehicle was only six months old at the time of the recall. We requested a replacement vehicle due to the seriousness of the safety defect and the lack of a repair timeline, but Toyota denied this request and has offered no long-term solution. I am filing this complaint due to the unreasonable delay, loss of use, and lack of a permanent remedy for a serious safety defect involving child passenger seating.
